IN NO EVENT SHALL THE TOTAL AGGREGATE LIABILITY OF GREEN LANTERN PIZZA TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE WEBSITE OR SERVICES EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO GREEN LANTERN PIZZA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED UNITED STATES DOLLARS ($100.00).

THE LIMITATIONS OF LIABILITY SET FORTH IN THIS SECTION ARE A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN GREEN LANTERN PIZZA AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN THEIR ENTIRETY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

The arbitration shall be conducted on an individual basis. Neither you nor Green Lantern Pizza may bring any claim as part of a class action, class arbitration, or other representative action or proceeding. BY ENTERING INTO THESE TERMS, YOU AND GREEN LANTERN PIZZA ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE IN A CLASS ACTION.

13.3 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes that fall within that court's jurisdiction, provided the action remains in small claims court and is not removed or appealed to a court of general jurisdiction.

13.4 Exceptions

Nothing in this Section shall prevent either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent or stop actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or other proprietary rights.
